Article 1 – Principles
These general terms and conditions set out all obligations of the parties. As such, the buyer is deemed to accept them without reservation.
These general terms and conditions of sale apply to the exclusion of all other conditions, including those applicable to in-store sales or through other distribution or marketing channels.
They are accessible on the FT Distribution SAS website and shall prevail, where applicable, over any other version or contradictory document.
The seller and the buyer agree that these general terms and conditions exclusively govern their relationship. The seller reserves the right to modify these terms and conditions from time to time, which shall become applicable as soon as they are published online.
If any sales condition is missing, it shall be governed by the practices in force in the French distance selling sector.
Article 2 – Content
These general terms and conditions define the rights and obligations of the parties within the framework of the online sale of products offered by the seller to the buyer via the FT Distribution SAS website.
They apply exclusively to purchases made on the website and delivered only within mainland France.
Article 3 – Pre-contractual Information
The buyer acknowledges having received, prior to placing the order and concluding the contract, these general terms and conditions of sale and all information provided for under Article L.221-5 of the French Consumer Code, in a clear and understandable manner.

Article 4 – Orders
The buyer may place an order online using the catalog available on the website, through the form provided for this purpose, subject to product availability.
The buyer will be informed of any unavailability of an ordered product.
For the order to be valid, the buyer must accept these Terms and Conditions by checking the designated box. The buyer must also provide a delivery address, select a delivery method, and validate a payment method.
The sale shall be considered final:
Any order implies acceptance of the prices and descriptions of the available products.
In the event of a problem (payment refusal, incorrect address, etc.), the seller reserves the right to block the order until the issue is resolved.

Article 5 – Electronic Signature
Providing a bank card number and final confirmation of the order constitute proof of the buyer's agreement, payment obligation, signature, and express acceptance of all operations carried out.

Article 6 – Order Confirmation
The seller will confirm the buyer's order by email.
Article 7 – Proof of Transaction
The computerized records kept by the seller under reasonable security conditions shall constitute proof of communications, orders, and payments between the parties.
Article 8 – Product Information
The products governed by these Terms and Conditions are those listed on the seller's website and indicated as sold and shipped by the seller, subject to availability.
Descriptions and photographs are as accurate as possible but are not contractually binding.
Article 9 – Prices
The seller reserves the right to modify prices at any time while undertaking to apply the rates in force at the time the order is validated.
Prices are indicated in euros, all taxes included (VAT included). Delivery charges are specified before order validation.
Article 10 – Payment Terms
Any order implies an obligation to pay.
Payment is made by bank card through the secure payment system implemented by the website's payment provider.
The seller reserves the right to suspend or cancel any order in the event of non-payment or an ongoing dispute.
Article 11 – Availability – Refund – Contract Termination
In the event of product unavailability, the buyer will be informed and may request a refund or exchange.
If delivery does not occur within 65 days after payment (excluding address errors), the buyer may request a full refund.
Article 12 – Delivery
Products are delivered to the address provided by the buyer during the order process.

Article 14 – Legal Guarantees
In accordance with Articles L.217-4 and following of the French Consumer Code, the buyer benefits from the legal guarantee of conformity (2 years) as well as the warranty against hidden defects (Articles 1641 and following of the French Civil Code).
In addition, we offer a 1-year commercial warranty on our pillows. If your pillow is defective or broken within 1 year of purchase, we will send you a replacement free of charge. Please note that this warranty covers replacement only — no order refund will be issued under this warranty.
Article 15 – Right of Withdrawal
The buyer has a period of 30 days from receipt of the product to exercise their right of withdrawal and return the product, complete and in perfect condition. Return shipping costs are the responsibility of the buyer.
Please note that pillowcase orders cannot be returned or exchanged if the wrong size or color was selected. We encourage buyers to carefully review their selection before placing an order.
Certain products cannot be returned (hygiene products, opened cosmetics, etc.).
Article 16 – Force Majeure
Any unforeseeable, irresistible, and external event preventing the normal execution of the contract shall constitute force majeure (strike, natural disaster, pandemic, logistical blockage, etc.).
Article 17 – Intellectual Property
The content of the website remains the exclusive property of FT Distribution SAS. Any reproduction is strictly prohibited.
Article 18 – Protection of Personal Data
The data collected are necessary for processing orders.

Article 19 – Partial Invalidity
If any provision of these Terms and Conditions is declared void, the remaining clauses shall remain applicable.

The seller's failure to invoke a breach by the buyer shall not constitute a waiver of the right to invoke it at a later date.
Article 21 – Headings
The headings of the articles have no contractual value.
Article 22 – Contract Language
These Terms and Conditions are drafted in French. In the event of translation, only the French version shall prevail.
Article 23 – Mediation
In the event of a dispute, the buyer may resort to a consumer mediator or any alternative dispute resolution method.
Article 24 – Applicable Law
These general terms and conditions are governed by French law.
